These Terms of Service (“Terms”) govern your use of the services provided by Tow Hub Brisbane (“we”, “us”, “our”). By requesting or using our services, you agree to these Terms.

Services

We provide towing, recovery, and roadside assistance (e.g., jump starts, fuel delivery, flat tyres) across Brisbane and surrounding areas. Service availability, response times, and capabilities may vary by location, traffic, weather, vehicle type/condition, and driver availability.

Quotes, pricing & payment

Quotes/estimates (if provided) are not binding until confirmed at the scene or in writing; final charges may vary due to distance, wait time, access, load, special equipment, after-hours/holiday rates, or unforeseen conditions.

Payment is due as agreed (e.g., on completion or per invoice). We may accept card, EFT, or other methods via our payment processor.

Storage fees may apply if your vehicle is left at or moved to a storage facility or yard.

Tolls/fees (e.g., road tolls, ferries, special permits) may be added to the final invoice.

Customer responsibilities

You agree to:

Provide accurate and complete information (location, vehicle, drop-off).

Ensure the vehicle is accessible and safe to approach.

Secure valuables and remove personal belongings before tow (we are not responsible for lost items).

Comply with directions for safety at the roadside.

Confirm you have the authority to request services for the vehicle (owner/insurer/authorised agent).

Insurance & third parties

We are not an insurer and do not provide insurance coverage for the vehicle or contents.

Any insurance claims are between you and your insurer. We may provide documentation to support a claim where appropriate.

Where services are arranged through or for a third party (e.g., insurer, fleet), their terms may also apply.

Vehicle condition & limits

We may refuse or suspend service if conditions are unsafe (e.g., dangerous location, hazardous load, extreme weather) or beyond our equipment capability.

Off-road recovery, heavy vehicles, boats, caravans, or machinery may require special equipment and incur additional charges.

We are not responsible for pre-existing damage, hidden defects, or damage arising from necessary towing/recovery methods where reasonable care is taken.

Cancellations & no-shows

You may cancel before dispatch at no charge.

If a driver has been dispatched or arrives at the scene and the job is cancelled, a call-out fee and/or wait time may apply.

Timing & availability

We aim for prompt assistance but do not guarantee specific arrival times. Delays can occur due to traffic, weather, access, and other factors outside our control.

Acceptable use (website & communications)

You agree not to misuse our website or communication channels (e.g., transmitting harmful content, unauthorised access, harassment).

Intellectual property

Website content, logos, and materials are owned by or licensed to us and are protected by law. You may not use them without permission.

Liability

To the extent permitted by law:

Our liability is limited to re-supply of services or the cost of re-supply under the Australian Consumer Law (ACL).

We are not liable for indirect or consequential loss, loss of profit, or business interruption.

Nothing in these Terms excludes rights you may have under the ACL that cannot be excluded.

Indemnity

You agree to indemnify us against losses arising from your breach of these Terms, your misuse of the services, or your failure to provide accurate information or safe access.

Force majeure

We are not responsible for delay or failure caused by events beyond our reasonable control (e.g., severe weather, accidents, strikes, outages).

Governing law

These Terms are governed by the laws of Queensland, Australia, and the parties submit to the exclusive jurisdiction of its courts.

Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Continued use of our services after changes means you accept the updated Terms.
